JAMS definition

JAMS means JAMS, Inc. or its successor entity, a judicial arbitration and mediation service.

If the parties cannot otherwise agree on a location for the arbitration, the arbitration shall take place in the county in which JAMS services are offered that is nearest to where you primarily performed Delivery Services for Caviar at the time the dispute arose.

If you and Caviar do not reach such a solution within a period of 60 days from when you first emailed Caviar to initiate this procedure, then, upon notice by either party to the other, the dispute will be finally resolved by arbitration administered by JAMS.

Either Party may initiate Arbitration by filing with the JAMS a notice of intent to arbitrate at any time following the unsuccessful conclusion of the management negotiations provided for in Section 18.2.

If the Parties cannot mutually agree on the arbitrator who will adjudicate the dispute, then JAMS shall provide the Parties with an arbitrator pursuant to its then-applicable Commercial Arbitration Rules.

The arbitration shall be administered pursuant to the JAMS Employment Arbitration Rules & Procedures (the “JAMS Rules”) then in effect (available at www.jamsadr.com), unless such rules are in conflict with this Arbitration Agreement, in which case, the terms of this Arbitration Agreement will control.
