The Tenderer/ Bidder shall bear all costs / expenses associated with the preparation and submission of the Tender(s) and the Purchaser or Client shall in no case be responsible / liable for those costs / expenses.
All vendors that Supplier hires will bill Supplier directly (as opposed to Purchaser or Client) except as otherwise expressly agreed by Purchaser in writing.
If, upon such audit, Client or Purchaser shall determine that Supplier’s charges exceed the amounts properly chargeable to Purchaser or Client as the case may be, Supplier shall without limiting Purchaser’s other available rights or remedies promptly refund to Purchaser or Client, as appropriate, the amount of such overcharges.
Any and all property of Purchaser or Client, in the possession or control of Supplier, shall be and remain the property of Purchaser or Client (as applicable), and Supplier shall be responsible for any loss or damage occurring to such property while such is in Supplier’s possession or control.
Supplier shall ensure that it and its employees on site are familiar with applicable Laws and any policies of Purchaser or its client relating to protection of the environment and shall ensure that it and all of its employees strictly comply with all such applicable Laws and Purchaser or Client policies.
For such period of three years, Purchaser and/or Client shall have the right to audit (i) the books and records relating to all such charges, and (ii) any other materials related to Supplier’s compliance with the terms and conditions of this Order, and Supplier, upon request of Purchaser or Client, shall make all such books and records available for such examination.
The Purchaser or The Client shall monitor day-to-day operations and performance of the KPOs. The decision of the Purchaser or Client will prevail in every case of dispute.IX.
The Contractor shall deliver the Goods at various Government Offices in Punjab, as specified by the Purchaser or Client (Waste Management Companies) at the time of delivery.40.1 The Goods shall remain at the risk and under the physical custody of the Contractor until the delivery, testing and taking over of the Goods is completed.40.2 The Contractor shall ensure that the Goods shall be delivered complete to enable the testing and training to proceed without interruption.
The Supplier shall be responsible and account for all material issued free, whether directly or indirectly by the Purchaser or Client.
The Purchaser or Client must notify us of all visible defects in the goods within 48 hours of their delivery, whereby our liability in respect of visible defects shall in any event remain limited to replacement of the defective goods, excluding all costs or compensation.
