Notice of Enforcement definition

Notice of Enforcement as defined in the Trust Agreement.

Notice of Enforcement means a notice pursuant to Section 2.9 hereof that a Secured Party is enforcing its rights against all or any portion of the Indemnification Collateral.

Notice of Enforcement means a written notice from the Collateral Agent to the Custodian substantially in the form set out in Exhibit C of this Agreement.

• If CSD determines that Contractor’s non- compliance has resulted in questioned costs, CSD shall provide Contractor with a Statement of Questioned Costs along with the Notice of Enforcement Action, or at such later time in the enforcement process as questioned costs are identified.

• The Captain of the Port, Sector Lake Michigan, will establish enforcement dates that will be announced with a Notice of Enforcement and marine information broadcasts.

• Within five business days of receipt of a Notice of Enforcement Action, Contractor may request a hearing for the parties to consider the matters addressed in the Notice and to discuss alternative courses of action, which meeting CSD may agree to if, in its sole judgment, it determines that the meeting would be helpful to the process, can be held expeditiously, and will not cause undue delay or further jeopardize taxpayer dollars.

• Notice of Violations and Notice of Enforcement received from TCEQ shall include those classified as major violations and moderate violations under TCEQ'S regulations for documentation of Compliance History, 30TAC, Chapter 60.2 (c) (1) and (2).

• Where our planned attendance is delayed or cancelled by you or any other party, within 2 business days of the appointment or after service of our Notice of Enforcement, we reserve the right to charge 75% of any fixed fee we have already quoted to you in writing or 100% of the first hour fee, where we have quoted for the work by the hour.

More Definitions of Notice of Enforcement

Notice of Enforcement means a notice of enforcement given by the Covenant Holder in this Agreement;

Notice of Enforcement means a notice or notices delivered to the --------------------- Collateral Agent by Representatives and/or Unrepresented Holders in accordance with Section 4.02 stating that (a) all or part of the Obligations are due and payable and remain unpaid and any applicable grace period for payment thereof has lapsed or (b) all or part of the Obligations are then permitted by the Secured Instrument or Secured Instruments under which such Obligations are outstanding (because of the occurrence of an event of default or similar event under such Secured Instrument or Secured Instruments) to be declared due and payable prior to the stated maturity thereof pursuant to the terms of such Secured Instrument or Secured Instruments. A Notice of Enforcement shall be deemed to have been given when the notice referred to in the preceding sentence has actually been received by the Collateral Agent and to have been rescinded when the Collateral Agent has actually received a Notice of Cancelation of Enforcement. A Notice of Enforcement shall be deemed to be in effect at all times after such Notice of Enforcement has been given until such time, if any, as such Notice of Enforcement has been rescinded. The Representatives and Unrepresented Holders that delivered a Notice of Enforcement shall rescind such Notice of Enforcement once such Representatives and Unrepresented Holders are satisfied that the event or events giving rise to such Notice of Enforcement have been cured or waived in accordance with the applicable Secured Instrument and no other event has occurred and is continuing that would permit a Notice of Enforcement to be given.

Notice of Enforcement has the meaning assigned to such term in the Collateral Agency Agreement.

Notice of Enforcement means a notice from Lender to any Lessee under a Lease instructing each such Lessee under a Lease to pay all current and future Rents under the Leases directly to Lender, and attorn in respect of all other obligations thereunder directly to Lender.

Notice of Enforcement means a written certification given by or on behalf of any Senior Lender to the other Senior Lenders certifying that an Enforcement has occurred.

Notice of Enforcement means a notice by the Trustee to the Bank stating that the Trustee proposes to take one or more Enforcement Actions hereunder or under any other Related Document.
