  • Under no circumstance shall NNPC (NAPIMS) be liable for any losses or damages whatsoever, arising from or relating to the utilization of the portal, error in the transmission of information, interruption or suspension of the availability of access to the portal due to internet failure, undue utilization of the user party's password, including without limitation direct and indirect damages or losses, lost profits, or any other kind of indemnity.

  • Notwithstanding the outcome of any capability assessment report and/or performance feedback in the conduct of its obligations under this agreement, neither NNPC nor Buyers shall be held liable for any consequences thereof, and is hereby indemnified against and for all liabilities arising from the use of such reports.
