Legally free definition

Legally free means the status of a child when the legal rights of the child’s birth parents have been severed through death of a parent or a termination of parental rights proceeding accord- ing to the laws of the state or the tribal court, and the court has transferred guardianship and custody of the child to a placement agency pending adoptive placement.
Legally free means that, with respect to a child, the legal rights of all parents with legal standing have been judicially terminated, voluntarily relinquished, or otherwise terminated by operation of law, thus allowing for the child to be adopted.
