In disciplinary arbitrations concerning employee editorial/creative performance (e.g., editorial content; editorial quality; professional journalistic ethics), the Arbitrator may not substitute their judgment for the editorial judgment of Salon and shall conclude that Salon’s editorial standards and its judgments regarding same are reasonable unless rebutted by the Guild by substantial evidence.
