Existing Hazardous Materials definition

Existing Hazardous Materials means (i) with respect to the Existing Premises, Hazardous Materials existing on or about the Existing Premises as of the Lease Commencement Date and (ii) with respect to the Expansion Premises, Hazardous Materials existing on or about the Expansion Premises as of the Expansion Commencement Date.
Existing Hazardous Materials means Hazardous Materials located on the Property in violation of applicable Environmental Laws as of the date of this Lease. Landlord represents, to its actual knowledge, that there are no Existing Hazardous Materials in, on, under or about the Premises on the date this Lease is executed by Landlord and Tenant.
Existing Hazardous Materials means those Hazardous Materials, if any, specifically described as being present at the Project in excess of amounts permitted pursuant to Applicable Laws pursuant to those certain environmental reports listed on Exhibit 5.4.7, attached, copies of which have been provided to Tenant.

Examples of Existing Hazardous Materials in a sentence

  • Existing Hazardous Materials are Hazardous Materials discovered at the Project site and not introduced to the Project site by the Contractor, a Subcontractor, or anyone for whose acts they may be liable.

  • Any abatement of Existing Hazardous Materials will be the responsibility of the Owner.

  • A second portion of the parcel is zoned as El Granada Gateway and described as a largely open space.

  • Unless otherwise provided in the Special Provisions of the Agreement, the Owner shall have responsibility for the presence and abatement of Existing Hazardous Materials that may be discovered at the Project site.

  • Without limiting any other rights or remedies of County under this Lease, Tenant shall pay the cost of any cleanup or remedial work performed on, under, or about the Premises as required by this Lease or by applicable Laws in connection with the removal, disposal, neutralization or other treatment of such Hazardous Materials caused or permitted by Tenant or Tenant Parties, excluding the Existing Hazardous Materials.


More Definitions of Existing Hazardous Materials

Existing Hazardous Materials means Hazardous Materials located on the Property as of the Rent Commencement Date.
Existing Hazardous Materials has the meaning set forth in Section 10 of this Lease.
Existing Hazardous Materials means Hazardous Materials located on the Property in violation of applicable Environmental Laws as of the date of this Lease.
Existing Hazardous Materials has the meaning as defined in Section 10.3 hereof.
Existing Hazardous Materials shall not include the following to the extent the same are located on the Premises as of the date of this Lease (collectively, the "REMOVABLE HAZARDOUS MATERIALS"):
Existing Hazardous Materials means Hazardous Materials located on the Project in violation of applicable Environmental Laws as of the date of this Lease. Subject to the terms of the immediately preceding sentence, Tenant’s indemnity of Landlord also shall not apply to claims based upon Hazardous Materials that arise out of or are caused by the presence, use, generation, manufacture, treatment, handling, refining, production, processing, storage, Release or presence of Hazardous Materials in, on, under or about the Premises or Project by Landlord or any Landlord Parties or any third party or parties outside of the Premises.
Existing Hazardous Materials means any Hazardous Material present at the Site as of the Effective Date.
