Benefit Plan Investors definition

Benefit Plan Investors has the meaning specified in Section 2.11(d).
Benefit Plan Investors means as defined in the section of this Prospectus entitled
Benefit Plan Investors means employee benefit plans subject to Title I of ERISA, benefit plans subject to Section 4975 of the Code, government plans, church plans, Individual Retirement Accounts, K▇▇▇▇ Plans covering only self-employed persons and no employees, employee benefit plans covering only the sole owner of a business and/or his spouse and foreign pension plans.

  • An entity described in (iii) immediately above will be considered to hold plan assets only to the extent of the percentage of the equity interests in the entity held by Benefit Plan Investors.

Benefit Plan Investors include (a) any employee benefit plan (as defined in section 3(3) of ERISA), that is subject to Title I of ERISA, (b) any plan to which Section 4975 of the Internal Revenue Code applies, including, without limitation, individual retirement accounts and K▇▇▇▇ plans, and (c) any entity, the underlying assets of which include plan assets of a plan described in (a) or (b) above by reason of a plan’s investment in the entity, including without limitation for this purpose, the general account of an insurance company, any of the underlying assets of which constitute “plan assets” under Section 401(c) of ERISA, or a wholly owned subsidiary thereof.
Benefit Plan Investors means (i) any “employee benefit plan” (as defined in Section 3(3) of ERISA), subject to Title I of ERISA, (ii) any “plan” described in Section 4975(e)(1) of the Code to which Section 4975 of the Code applies, or (iii) any entity whose underlying assets could be deemed to include “plan assets” by reason of an employee benefit plan’s or a plan’s investment in the entity within the meaning of the Plan Asset Regulation or otherwise.
