Plan Assets definition
Plan Assets means “plan assets” within the meaning of the Plan Asset Regulations.
Plan Assets means assets of any (i) employee benefit plan (as defined in Section 3(3) of ERISA) subject to Title I of ERISA, (ii) plan (as defined in Section 4975(e)(1) of the Code) subject to Section 4975 of the Code, or (iii) governmental plan (as defined in Section 3(32) of ERISA) subject to federal, state or local laws, rules or regulations substantially similar to Title I of ERISA or Section 4975 of the Code.
Plan Assets means “plan assets” within the meaning of U.S. Department of Labor Regulation 29 C.F.R. Section 2510.3-101, as modified by Section 3(42) of ERISA.

The Fund intends to operate so that its assets are not deemed to include Plan Assets.
The Borrower shall not take any action or omit to take any action that would result in the Borrower failing to satisfy an exception under the Plan Asset Regulations which failure causes the assets of the Borrower to be deemed to constitute Plan Assets.

Plan Assets has the meaning given to such term in Section 3(42) of ERISA.
