Plan Assets Clause Samples
The "Plan Assets" clause defines what constitutes the assets of an employee benefit plan, typically for the purposes of regulatory compliance and fiduciary responsibility. It clarifies which funds, investments, or property are considered part of the plan’s assets, often referencing legal standards such as those set by ERISA. For example, it may specify that participant contributions held by a third-party administrator are plan assets once received, or that certain pooled investments are treated as plan assets under specific conditions. This clause is essential for ensuring that all parties understand their obligations regarding the management, protection, and reporting of plan assets, thereby reducing the risk of mismanagement or legal violations.
