Common use of Working File Clause in Contracts

Working File. An employee’s principal or program supervisor may maintain a supervisory file at his/her work site. • The supervisory file is kept for the purpose of containing material pertinent to the employee’s performance and for the completion of an employee’s evaluation(s). • The supervisor file may be maintained as long as the principal or program supervisor has the responsibility for evaluating the employee’s performance at the work site or program. When those responsibilities end, the contents of the file will be destroyed except for written documentation of counseling sessions and verbal warnings which will be forwarded to Human Resources. Documentation forwarded to Human Resources will be filed in the Human Resources office. Documentation of counseling sessions and verbal warnings will be destroyed after two (2) years, provided that no further issues of a similar nature have occurred during that period of time. • The supervisory file will be open for review by the employee upon request of the employee to set a mutually agreeable time for such review. The employee may choose to have a representative present.
