VACANCIES, TRANSFERS AND PROMOTIONS. A. A vacancy shall be defined as a newly created position or a present position that has been permanently vacated and which will be filled; except a vacancy will not be considered to exist if there is an employee on layoff status or leave status who is qualified for the position and ready, willing, and able to resume active employment.
