Common use of Transfer and Seniority Outside Bargaining Unit Clause in Contracts

Transfer and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside the Bargaining Unit without the employee's consent. An employee may be transferred to a temporary position outside of the Bargaining Unit for up to twelve (12) months. Such employees shall continue to pay union dues and receive all rights and privileges of the collective agreement. Upon returning to the Bargaining Unit, the employee will be placed in their former position. No employee shall discipline a member of the Bargaining Unit. No employee shall be eligible for another temporary position outside of the Bargaining Unit, until they have returned to a Bargaining Unit position for a period of twelve (12) months.
