Common use of Transfer and Seniority Outside Bargaining Unit Clause in Contracts

Transfer and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without the employee's consent. If an employee is transferred to a position outside the bargaining unit, the employee shall retain seniority accumulated up to the date of leaving the unit but will not accumulate any further seniority. Such employee shall have the right to return to a position in the bargaining unit for a maximum of six (6) months. If an employee returns to the bargaining unit, the employee shall be placed in the position held at the time of the transfer, or if that position is held by a senior employee or is redundant, the employee may bump laterally or downward provided this does not result in the layoff or bumping of an employee holding greater seniority.
