Common use of Transfer and Seniority Outside Bargaining Unit Clause in Contracts

Transfer and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside the Bargaining Unit without the employee's consent. If an employee is transferred to a position outside of the Bargaining Unit, the employee shall retain seniority accumulated up to the date of leaving the Unit but will not accumulate any further seniority. An employee shall have the right to return to the employee's former position in the Bargaining Unit during the trial period, which shall be a maximum of ninety (90) working days, without loss of seniority. If an employee returns to the Bargaining Unit, the employee shall be placed in a job consistent with the employee's seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.
