Severability and Survivability Sample Clauses

Severability and Survivability. If any provision, or portion of a provision, in these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. Traveler and PFL agree to substitute for such provision a valid provision which most closely approximates the intent and economic effect of such severed provision. Notwithstanding any other provisions of this these Terms and Conditions, or any general legal principles to the contrary, any provision of these Terms and Conditions that imposes or contemplates continuing obligations on a party will survive the expiration or termination of these Terms and Conditions.

Severability and Survivability. If any provision of this Lease is invalid or unenforceable under applicable law, it won’t invalidate the remain- der of the Lease or change the intent of the parties. Paragraphs 10.1, 10.2, 16, 27 and 31 shall survive the termination of this Lease. This Lease binds subsequent owners.
Severability and Survivability. This Arbitration Agreement shall survive: (i) termination or changes in the Agreement or the relationship between you and us concerning the Agreement; and (ii) the bankruptcy of any party. The Company reserves all remedies which it may have at law or in equity including, without limitation, injunctive relief. Executive acknowledges that the Company has the right to seek such relief, and Executive also agrees that the Company may do so without the necessity of proof of actual damage and without the requirement to post bond or other security.

Severability and Survivability. If any Section, provision or clause of this Franchise is held by a court of competent jurisdiction to be invalid or unenforceable, or is preempted by federal or state laws or regulations, the remainder of this Franchise shall not be affected, unless the City Council determines such Section, provision or clause was material to the City’s agreement to issue the Franchise. All provisions concerning indemnity shall survive the termination of this Agreement for any cause. Expiration or termination of this Franchise shall not extinguish, prejudice or limit either party’s right to enforce this Franchise with respect to any default or defect in performance that has not been corrected.‌
