Common use of Seniority Outside the Bargaining Unit Clause in Contracts

Seniority Outside the Bargaining Unit. ≈ (a) Effective date of signing, Regular Employees transferred for a temporary period of twelve (12) calendar months or less to a position outside of the Bargaining Unit shall have their seniority frozen at the level achieved on the date of departure from the Bargaining Unit. This dormant credited seniority will be reactivated upon the Employee’s return to a Regular Bargaining Unit position and the Employees seniority date described in Article 14.01 will be adjusted accordingly. The Employee will cease to pay union dues during the period of temporary employment and the terms of the Collective Agreement shall not otherwise apply to such employee while in the non-bargaining unit position. The Employer and the Employee can mutually agree to extend the period of the temporary assignment. However, a mutual agreement shall be required between the Employer and the Union in order to maintain the dormant seniority beyond the twelve (12) month period. Where no agreement is achieved and the Employee continues to work in the position for the period beyond the twelve (12) months, the Employee shall forfeit all seniority and their right to return to the Bargaining Unit.
