Right to Perform Services for Others. Avis recognizes that WizCom personnel providing Services to Avis under this Agreement may perform services similar to the Services from time to time for other customers; provided, however, that such personnel shall remain bound by the confidentiality provisions of this Agreement, and shall not disclose Avis Confidential Information except as provided in this Agreement.
Right to Perform Services for Others. Except for provisions set forth under Section 9.13, each Party recognizes that Subcontractor personnel providing Services to Company under this Agreement may perform similar services for others and this Agreement shall not prevent Subcontractor from using the personnel provided to Company under this Agreement for such purposes.

Each Party recognizes that IBM personnel providing Services to ACE under this Agreement may perform similar services for others and this Agreement shall not prevent IBM from using the personnel and equipment provided to ACE under this Agreement for such purposes. IBM may perform its obligations through its subsidiaries, Affiliates or through the use of IBM-selected independent contractors; provided, however, that IBM shall not be relieved of its obligations under this Agreement by use of such subsidiaries, Affiliates, or subcontractors.
Right to Perform Services for Others. Conexant acknowledges that PDF Solutions has extensive expertise, experience, technology and proprietary products and tools in the area of electronic design and yield improvement and that PDF Solutions intends to utilize such expertise, experience, products and tools in providing consulting services and other services to other clients. Subject to PDF Solutions' compliance with the confidentiality provisions stated herein, nothing in this Agreement shall restrict or limit PDF Solutions from performing such design consulting or other services to any other entity in any industry, including the semiconductor and electronics industries. Conexant agrees that, except as otherwise agreed in this Agreement, PDF Solutions and its employees may provide design consulting services similar in nature to the Services and Technology for any third parties both during and after the term of this Agreement. Subject to the limitations placed on PDF Solutions by this Agreement or by any existing Non-Disclosure Agreement between PDF Solutions and Conexant, PDF Solutions may in its sole discretion develop, use, market, license, offer for sale, or sell any software, application or product that is similar or related to that which was developed by PDF Solutions for Conexant hereunder.
Right to Perform Services for Others. Futura may perform services that are the same or substantially similar to the Services for other Futura clients. This Agreement shall not prevent or limit Futura from using any of its personnel, equipment, facilities or technology for such purposes.

Each Party recognizes that ISSC personnel providing Services to Comdata under this Agreement may perform similar services for others and this Agreement shall not prevent ISSC from using the personnel and equipment not listed in Schedule U that is provided to Comdata under this Agreement for such purposes. ISSC may perform its obligations through its subsidiaries, Affiliates or through the use of ISSC-selected independent contractors; provided, however, that ISSC shall not be relieved of its obligations under this Agreement by use of such subsidiaries, Affiliates, or subcontractors.
Right to Perform Services for Others. Subject to OT’s compliance with the confidentiality provisions stated herein, nothing in this Agreement shall restrict or limit OT or any OT subcontractors from providing services which may be similar to the Services to any other entity in any industry for services that are in accordance with Appendix C Pricing Index of DIR Contract Number DIR-CPO-4409. Services that are offered by Vendor on DIR-CPO-4409 shall establish preeminence for DIR Eligible Customers in accordance with Texas Government Code Chapter 2054, Subchapter A.
Right to Perform Services for Others. The Customer recognizes that MIRA is in the business of providing computer and information technology services and may perform services for other business that may be similar to the Services described by this Agreement. Subject to MIRA’s confidentiality obligations pursuant to Section 13, nothing in the Agreement shall prevent MIRA from providing similar services similar to the Services herein to any third person.
