Right to Accounting of Disclosures. Business Associate agrees to make an accounting of disclosures of PHI in the format provided by Covered Entity to Business Associate. Business Associate shall make this information available to Covered Entity, or to an individual directly if requested by the individual (with notice to Covered Entity), as necessary for the Covered Entity to provide an accounting of disclosures in accordance with 45 C.F.R. § 164.528 and the HITECH Act.

Right to Accounting of Disclosures. Business Associate agrees to make an accounting of disclosures of PHI in the format provided by Covered Entity to Business Associate within ten (10) days following the request of Covered Entity. Business Associate shall make this information available to Covered Entity, or to an individual if directed by Covered Entity, or to an individual directly if requested by the individual (with notice to Covered Entity), as necessary for the Covered Entity to provide an accounting of disclosures in accordance with 45 C.F.R. §164.528.
Right to Accounting of Disclosures. You may request a list of instances where we have disclosed your medical information for certain types of disclosures. The accounting will not include disclosures that we are not required to record, such as disclosures made pursuant to an authorization and those about treatment, payment and healthcare operations. This right is limited to disclosures within six years of the request. The first accounting you request within a 12-month period is free, but we will charge a fee for any additional lists requested within the same 12-month period.

Business Associate agrees to provide the accounting to Covered Entity, unless Covered Entity requests that the accounting be provided directly to the Individual. If Business Associate maintains PHI in an Electronic Health Record, the scope of accounting under this Section 5.3 shall further comply with the requirements of Section 13405(c) of HITECH as such requirements apply to Covered Entity.
Right to Accounting of Disclosures. You have the right to obtain a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why. All disclosures are pursuant to a signed release. We will include all the disclosures except for those about treatment, payment and health care operations, and certain other disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.

Right to Accounting of Disclosures. Business Associate shall document any disclosures of PHI that would be required for Provider to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with 45 C.F.R. § 164.528, and shall forward a copy of such documentation to Provider within ten (10) business days of Provider’s request for such documentation. Business Associate shall provide to Provider or an Individual, in the time and manner designated by Provider, any further information requested by Provider in order for Provider to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with 45 C.F.R. § 164.528. To the extent Business Associate makes any disclosures on behalf of Provider through an electronic health record as defined in Section 13400 of the HITECH Act, Business Associate will document all such disclosures of PHI as required under the HITECH Act and any implementing regulations, and to provide an accounting of disclosures directly to an Individual upon his/her request. Business Associate’s obligation to document disclosures made through an electronic health record and provide an accounting of such disclosures directly to Individuals upon request shall be effective as of the date by which business associates are required to comply with Section 13405(c) of the HITECH Act or such later date specified by the Secretary of HHS.
