Retention or Repurchase of Assets Essential to Receiver Clause Samples

The 'Retention or Repurchase of Assets Essential to Receiver' clause allows a receiver to retain or reacquire certain assets that are deemed critical for the continued operation or value of a business under receivership. In practice, this clause may permit the receiver to prevent the sale or transfer of key equipment, intellectual property, or inventory, or to buy back such assets if they have already been disposed of, ensuring the business can continue functioning effectively. Its core function is to empower the receiver to preserve the value and operational integrity of the business, thereby maximizing returns for creditors and stakeholders during insolvency proceedings.
