Qualification as Affordable Housing. Rental Housing. HOME-Assisted Units must be occupied only by households that are eligible as low-income families or very-low income families, all as defined in 24 CFR §92.2, and must meet the requirements to qualify as affordable housing pursuant to 24 CFR §92.252, as provided herein (“Affordability Requirements”).
Qualification as Affordable Housing. During the Period of Affordability, HOME-assisted rental units shall be managed in accordance with regulations published at 24 CFR 92 Subpart FProject Requirements. Affordability must be maintained using guidelines set in 24 CFR 24.292. Household income must be calculated in accordance with regulations published at 24 CFR Part 5, Subpart F.
Qualification as Affordable Housing. Any housing assisted with HOME Program funds must meet the affordability requirements of 24 C.F.R. § 92.252 or § 92.254, as applicable. Should any housing assisted with HOME Program funds under this Agreement not meet the affordability requirements as specified above, all HOME Program funds invested in such housing shall be repaid to CITY by DEVELOPER.

The Affordability Requirements as they pertain to the developer will be in the form of a deed of trust that will be recorded against the properties subjecting them to encumbrances totaling [total amount of HOME funds being provided for project]. The deed of trust shall be subordinate to construction financing, if applicable, and MDHA shall provide releases for individual properties when fee simple title is transferred to income-eligible homebuyers and developer has complied with all terms of this Agreement.
