Provision of Information by DBS. Where a referral is made to the DBS or the DBS become aware that an individual has met the prescribed criteria for a relevant automatic inclusion in either barred list the following process will be adopted;  The DBS will check documents that it has been provided with to determine whether the individual’s last known job is such that the individual would fall within the remit of the NCTL. If this is the case, the file will be marked as ‘of interest to the NCTL’ and the NCTL database will be checked to establish whether there is already a TRN.  The DBS will, as part of its information gathering process, write to the NCTL requesting information under section 46 SVGA.  In response, and in addition to providing any information that it has a duty to provide, the NCTL will confirm that they have an interest in the case and provide confirmation of the TRN (if held) to the DBS.  On receipt the DBS will enter the TRN onto its case management system (uCRM) and register the NCTL’s interest in the case. If no TRN is supplied the case will be appropriately marked with the NCTL’s interest so that, at the conclusion of the case, the DBS can advise the NCTL (as appropriate) of the barring decision and/or referred information.  Where the DBS make a ‘not to bar’ decision at any stage of its decision making process and a TRN is recorded, or the case file is appropriately marked, they will send referred information to the NCTL for their professional conduct consideration. In these cases information will be provided by post to the NCTL at the address in section 1. On a weekly basis the DBS will conduct an advanced search against its uCRM system with the aim of identifying those individuals with a recorded TRN who have either been barred or removed from a barred list, where the NCTL has previously declared, under s47 (1) – (4) of SVGA, that the individuals fall within their functions at s141B – E of the Education Act 2002 (as amended). .
