Common use of Proration of Annual Vacation Entitlement Clause in Contracts

Proration of Annual Vacation Entitlement. (a) Absences due to sick leave, income continuance, or workers’ compensation injury. Annual vacation entitlement will not be reduced for absences due to the above reasons unless an employee who is absent for a period exceeding two (2) years for the above reason(s) is deemed totally disabled and does not return to work, except as provided below. In the year an employee resumes employment after an absence due to the above reasons of more than two (2) years, the annual vacation in the year of return will be prorated by one twelfth (1/12) for each month of absences in the year of return.
