Project Documents Reserved Rights. Purchaser understands and acknowledges that the Project Documents contain a number of other significant and broad reservations of rights and powers held by Seller, including rights with respect to phasing and modifying the Project. Without limitation, Section R of the Declaration specifies many of the reserved rights of Seller. The current intent of Seller is to exercise those rights to amend the Declaration and Condominium Map from time to time to create and construct additional units as well as additional parking areas, mailboxes, and the like. However, whether any further units or improvements are constructed and the type of units and other improvements constructed will depend upon various factors including, without limitation, market demand. The Seller may also elect to reduce the size of the Project by deleting any of the units that have not been sold and/or to remove part of Parcel FF from the Project. The common interest appurtenant to the Purchaser’s Property, and therefore the Purchaser’s share of common expenses, will be adjusted upon each addition or deletion of units so that the common interest for each unit shall be calculated by dividing the unit’s Net Living Area by the Net Living Area of all units in the Project; provided that the Seller shall have the right, it its sole discretion, to round the results of such calculations so that the sum of the common interests equals exactly one hundred percent (100%). Additionally, the owners of a unit do not become liable for a share of the common expenses until a certificate of occupancy is issued for the unit; therefore, notwithstanding the common interest appurtenant to all of the units, until such time as all units have been constructed and have received a certificate of occupancy, the share of common expenses shall be allocated among the units for which certificates of occupancy have been issued, based on the relative Net Living Areas of such units. Purchaser is strongly urged to review the Project Documents for a complete discussion of the Seller’s reserved rights. PURCHASER HEREBY SPECIFICALLY CONSENTS AND AGREES TO ALL SUCH RESERVATIONS AND POWERS SET FORTH IN ANY AND ALL OF THE PROJECT DOCUMENTS. PURCHASER’S INITIAL(S)

  • Project Documents In addition to any other pertinent and necessary Project documents, the following documents shall be used in the development of the Project:

  • Project Documentation All documentation provided to the City other than Project drawings shall be furnished on a Microsoft compatible compact disc.

  • Project contract 1. For each approved project a project contract shall be concluded between the Programme Operator and the Project Promoter.

  • Rights in Documents and Work Any and all reports, photographs, surveys, and other data and documents provided or created in connection with this Agreement are and shall remain the property of City; and Contractor disclaims any copyright in such materials. In the event of and upon termination of this Agreement, any reports, photographs, surveys, and other data and documents prepared by Contractor, whether finished or unfinished, shall become the property of City and shall be delivered by Contractor to the City’s Contract Administrator within seven (7) days of termination of this Agreement by either party. Any compensation due to Contractor shall be withheld until Contractor delivers all documents to the City as provided herein.

  • Construction Contract Documents The Construction Contract Documents shall consist of the plans and specifications prepared by the Engineer, and any addenda and change orders thereto, and the Owner-Contractor Agreement, all of which shall be compatible and consistent with this Agreement.

  • INTENT OF CONTRACT DOCUMENTS 1.1 It is the intent of the Contract Documents to describe a functionally complete Project (or portion thereof) to be constructed in accordance with the Contract Documents. Any work, materials or equipment that may reasonably be inferred from the Contract Documents as being required to produce the intended result shall be supplied whether or not specifically called for. When words which have a well-known technical or trade meaning are used to describe work, materials or equipment, such words shall be interpreted in accordance with that meaning. Reference to standard specifications, manuals or codes of any technical society, organization or association or to the laws or regulations of any governmental authority having jurisdiction over the Project, whether such reference be specific or by implication, shall mean the latest standard specification, manual, code, law or regulation in effect at the time the Work is performed, except as may be otherwise specifically stated herein.

  • Intellectual Property Rights in Construction Documents, Drawings, and Models The drawings, Specifications and other documents prepared by the Design Professional pursuant to this Contract (including, without limitation, the Construction Documents), are the property of the Owner, whether or not the Project for which they are made commences or completes construction. Neither the Contractor nor any Subcontractor or material or equipment supplier shall own or claim a copyright in such drawings, Specifications, and other similar or related documents; Owner shall retain all common law, statutory, and other intellectual property rights with respect thereto. The Contractor must deliver remaining copies of such documents to the Owner upon request or upon completion of the Work, except that the Contractor may keep one copy of such documents for its files. The Contractor shall only use such drawings, Specifications and other documents for this Project. Neither the Contractor nor any Subcontractor or material or equipment supplier may use such drawings, Specifications, and other documents on other projects without the specific written consent of the Owner. All models are the property of the Owner.
