Procedural Workarounds. In the event that TTC-IADS is unable to fully correct any Software Error in a timely manner pursuant to 2.1 above, TTC-IADS, at its sole discretion, shall assert its best efforts to provide procedures, routines, or instructions (“Procedural Workarounds”) for use by Licensee of the TTC-IADS Software, which, when employed in the regular operation of the TTC-IADS Software and utilization of the Documentation, will avoid or substantially diminish the practical adverse effects of the relevant Software Error.

Procedural Workarounds. In the event that Illumina fails or is unable to correct any Error, Illumina will use commercially reasonable efforts to develop in a timely fashion procedures or routines, for use by You, which, when employed in the regular operation of, or access to, the Service, will avoid or substantially diminish the practical adverse effects of the relevant Error, provided that any failure or inability by Illumina to develop any such procedure or routine, or failure or inability to do so in a timely fashion, will in no event be deemed a breach of Illumina’s obligations under the Agreement.

(the “Act”). The Amendment was submitted with the Petition. A statement in support of the Petition was filed along with verifications sworn to by Xxxx Xxxxxx on behalf of Ameritech Illinois, and by Xxx Xxxxxx on behalf of Voicestream, stating that the facts contained in the Petition are true and correct to the best of their knowledge, information, and belief. Illinois Commerce Commission Staff filed the Verified Statement of X. Xxxxxxxx Xxxxxxx, of the Commission’s Telecommunications Division. Pursuant to notice as required by law and the rules and regulations of the Commission, this matter came on for hearing before a duly authorized Administrative Law Judge of the Commission at its offices in Chicago, Illinois, on January 7, 2003.   • Procedural Steps 33. a.   • Technical Objections to Grievance No grievance will be defeated or denied by any minor technical objection.

The arbitrator(s) shall provide each of the Parties an opportunity to be heard and, except as otherwise provided herein, shall conduct the arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“Arbitration Rules”) and any applicable FERC regulations; provided, however, in the event of a conflict between the Arbitration Rules and the terms of this Article 27, the terms of this Article 27 shall prevail.

  • Procedural Matters The Trustee may maintain a proceeding even if it does not possess any of the Notes or does not produce any of them in such proceeding. A delay or omission by the Trustee or any Holder in exercising any right or remedy following an Event of Default will not impair the right or remedy or constitute a waiver of, or acquiescence in, such Event of Default. All remedies will be cumulative to the extent permitted by law.
