Periodic Statements of Construction Cost and Redesign Design Services to Stay Within Construction Budget. Princeton University will require the Design Builder to prepare and update detailed Statements of Construction Cost based on the Design Documents as provided in Part III paragraphs (e), (g) and (h) of the Contract. At the end of each design phase of the Project, and after submission of each Statement of Construction Cost as required by the Contract, Princeton University and the Design Builder and its Design Professional shall meet to review and discuss the scope of Work and the Statement of Construction Cost (and, where Princeton University has retained a separate costing estimating consultant, to reconcile any differences between the respective Statements of Construction Cost). In the event that the Design Builder’s Statement of Construction Cost (or the reconciled Statement of Construction Cost where Princeton University has retained a separate cost consultant), is greater than the Construction Budget, the Design Builder shall cause the Design Professional, if requested by Princeton University in its sole discretion, to redesign the Project and, after consultation with Princeton University, revise the Design Documents on the basis of which such Statement of Construction Cost was prepared, until Design Builder (and Princeton University’s separate cost consultant, if any) are able to issue a revised Statement of Construction Cost that does not exceed the Construction Budget. All services, whether Preconstruction Services or Design Services, with respect to the revision of Design Documents because the Statement of Construction Cost was greater than the Construction Budget shall be provided by Design Builder and/or its Design Professional as part of the Preconstruction Services and/or Design Services at no additional cost to Princeton University (i.e., no increase to the Fixed Price For Preconstruction Services and/or NTE Design Price or its components).   • Project Construction Budget The project construction cost allowance specifically stated in writing as the ‘revised’ or ‘current’ ‘Project Construction Budget’ by the Trustees at each applicable phase of plan development.

  • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • ADDITIONAL CONSTRUCTIONS The Promoter undertakes that it has no right to make additions or to put up additional structure(s) anywhere in the Project after the building plan has been approved by the competent authority(ies) except for as provided in the Act.

  • DIRECT CONSTRUCTION COST Direct Construction Cost means the sum of the amounts that Contractor actually and necessarily incurs constructing the Project in strict compliance with the Construction Documents. Direct Construction Cost includes only the cost categories set forth in this Article and does not include the Pre-Construction Phase Fees or the Construction Phase Fees unless specifically noted. References in the UGSC to adjustments in “cost” or “costs” mean the Direct Construction Cost.

  • BUILDER’S RISK FOR NEW CONSTRUCTION PROJECTS If the project is NEW CONSTRUCTION, then the following provisions apply:

  • PRE-CONSTRUCTION PHASE SERVICES The Pre-Construction Phase shall be deemed to commence upon the date specified in a written Notice to Proceed with Pre-Construction Phase Services issued by Owner and shall continue through completion of the Construction Documents and procurement of all major Subcontractor agreements. Contractor is not entitled to reimbursement for any costs incurred for Pre-Construction Phase Services performed before issuance of the written Notice to Proceed. Pre-Construction Phase Services may overlap Construction Phase Services. Contractor shall perform the following Pre-Construction Phase Services:

  • ADDITIONAL CONSTRUCTION The Promoter undertakes that it has no right to make additions or to put up additional structure(s) anywhere in the Project after the building plan has been approved by the competent authority (ies) except for as provided in the Act.

  • PRE-CONSTRUCTION PHASE FEE The Pre-Construction Phase Fee is the total compensation payable to Contractor for the performance of Pre-Construction Phase Services, except for Additional Pre-Construction Phase Services approved in advance and in writing by Owner. The Pre-Construction Phase Fee shall be a lump sum amount based on the AACC established in this Agreement.

  • BUILDER’S RISK FOR CONSTRUCTION RENOVATION PROJECTS If the project is CONSTRUCTION RENOVATION of an existing structure, and the State has already determined that Contractor will not be obligated to obtain and maintain Builder’s Risk insurance, then the following provisions apply:

  • COMPENSATION FOR CONSTRUCTION PHASE SERVICES 5.1 For the Construction Manager’s performance of the Work as described in Section 2.3, the Owner shall pay the Construction Manager the Contract Sum in current funds. The Contract Sum is the Cost of the Work as defined in Section 6.1.1 plus the Construction Manager’s Fee.
