Common use of Periodic Leave Clause in Contracts

Periodic Leave. On out of town projects of over fifty (50) calendar days' duration, the Employer shall provide leave every forty (40) calendar days. When leave is desired in accordance with the above terms the Employer shall provide on a "use it or lose it" basis, an allowance based on the following formula: 250 km to 500 xx 000 xx xx 000 xx 000 xx to 1000 km over 1000 km $175.00 $275.00 $375.00 $475.00 The mileage will be computed from the project to the dispatch point or employee's place of domicile as stipulated in the respective collective agreement. It is agreed that the above amounts will be paid only once for each turnaround. The extent of the leave shall be for a minimum of five (5) days to a maximum of one (1) week or a number of days mutually agreed between the employee and the Employer's representative. The timing of the leave shall also be decided by mutual agreement. In no event will an employee receive leave unless he actually returns to his place of departure. Living out allowances shall not be paid during leave periods.
