Payments to Named Plaintiffs Sample Clauses

Payments to Named Plaintiffs and Class Members shall not be considered as a payment of overtime, salary, wages and/or compensation under the terms of any company benefit plan or for any purpose except for tax purposes as provided under Section IV.B. The receipt of settlement payments shall not affect the amount of any contribution to or level of benefits under any company benefit plan.

Payments to Named Plaintiffs. 9.1 Each Named Plaintiff who is a member of the Settlement Class may participate in the claims process described in Section VI of this Agreement to the same extent as Class Members.
Payments to Named Plaintiffs. In exchange for and subject to the terms of a general release of all claims, Class Counsel shall distribute a total of $40,000 computed as $5,000 to each of the (7) Named Plaintiffs and $5,000 to Xxxxxx Xxxxx for their remaining individual claims and/or for their efforts on behalf of the class. Class Counsel also shall distribute the following amounts to each of the Named Plaintiffs for their retaliation claims and any other claims they have or may have against the Released Parties as set forth more fully in their individual, general releases: $28,000 to Xxxxxxx Xxxxx and $21,000 to each of the other Named Plaintiffs. These amounts exclude (and are in addition to) any amounts due to the Named Plaintiffs and Xxxxxx Xxxxx under the immediately preceding subparagraph. Named Plaintiffs and Xxxxxx Xxxxx will be required to execute a full and complete release of any and all claims, known and unknown, against the Released Parties, and Class Counsel shall not distribute any funds to a Named Plaintiff or Xxxxxx Xxxxx until CARS has received a fully executed and enforceable copy of the general release. Class Counsel, subject to verification by CARS' counsel, will issue an IRS Form 1099 (identifying CARS as the payor) to each Named Plaintiff and Xxxxxx Xxxxx. Named Plaintiffs and Xxxxxx Xxxxx shall be solely responsible for all tax liabilities, assessments and penalties, if any, relating to their personal tax obligations arising from receipt of part of the Settlement Payment. Named Plaintiffs and Xxxxxx Xxxxx will provide Class Counsel required tax forms prior to payment.

  • Payments to Settlement Class Members (a) Defendant shall pay into the Escrow Account the amount of the Settlement Fund ($1,000,000.00), specified in Paragraph 1.33 of this Agreement, within sixty (60) days after Final Approval.

  • Rollovers of Settlement Payments From Bankrupt Airlines If you are a qualified airline employee who has received a qualified airline settlement payment from a commercial airline carrier under the approval of an order of a federal bankruptcy court, you are allowed to roll over up to 90 percent of the proceeds to your Traditional IRA, within 180 days after receipt of such amount, or by a later date if extended by federal law. If you make such a rollover contribution, you may exclude the amount rolled over from your gross income in the taxable year in which the airline settlement payment was paid to you. If you are a qualified airline employee who has received a qualified airline settlement payment from a commercial airline carrier under the approval of an order of a federal bankruptcy court in a case filed after September 11, 2001, and before January 1, 2007, you are allowed to roll over any portion of the proceeds into your Xxxx XXX within 180 days after receipt of such amount, or by a later date if extended by federal law. For further detailed information and effective dates you may obtain IRS Publication 590-A, Contributions to Individual Retirement Arrangements (IRAs), from the IRS or refer to the IRS website at xxx.xxx.xxx.

  • Overpayments to Contractor Contractor shall refund to Participating/Purchasing Entity the full amount of any erroneous payment or overpayment under this Master Agreement within thirty (30) days’ written notice. If Contractor fails to make timely refund, Purchaser may charge Contractor one percent (1.5%) per month on the amount due, until paid in full.

  • Rollovers of Exxon Xxxxxx Settlement Payments If you receive a qualified settlement payment from Exxon Xxxxxx litigation, you may roll over the amount of the settlement, up to $100,000, reduced by the amount of any qualified Exxon Xxxxxx settlement income previously contributed to a Traditional or Xxxx XXX or eligible retirement plan in prior taxable years. You will have until your tax return due date (not including extensions) for the year in which the qualified settlement income is received to make the rollover contribution. To obtain more information on this type of rollover, you may wish to visit the IRS website at xxx.xxx.xxx.

  • PAYMENTS TO CONTRACTOR (a) Payments to Contractor will be made on a monthly basis and within thirty (30) days from receipt of a correct invoice or billing statement in accordance with the Texas Government Code, Chapter 2251, known as the Texas Prompt Payment Act. An invoice is considered received on the date it is date stamped by TFC. Contractor will be paid for completion of work accepted and approved by TFC’s Contract Administrator.

  • Invoicing for Charges Against the Judicial Council’s Master Account A. The Contractor shall establish a Master Account for the Judicial Council’s charges provided for under the exhibits of this Agreement.

  • When Must Distributions from a Xxxxxxxxx Education Savings Account Begin? Distribution of a Xxxxxxxxx Education Savings Account must be made (or otherwise will be deemed made) no later than 30 days from the earlier of the beneficiary’s death or attainment of age 30. A distribution from a Xxxxxxxxx Education Savings Account may be rolled over to another beneficiary’s Xxxxxxxxx Education Savings Account according to the requirements of Section (4). Note that the Economic Growth and Tax Relief Reconciliation Act of 2001 waives the distribution age limitation if the beneficiary of the Xxxxxxxxx Education Savings Account is a “Special Needs” student.

  • Payments to Subcontractors Develop and implement a procedure for the review, processing and payment of applications by subcontractors for progress and final payments.

  • What Forms of Distribution Are Available from a Xxxxxxxxx Education Savings Account Distributions may be made as a lump sum of the entire account, or distributions of a portion of the account may be made as requested.

  • Settlement Class Members “Settlement Class Members” shall mean all persons in the Class who do not exclude themselves pursuant to Section F, herein, and those who submit a Valid Claim.
