Pair Gain Technologies. GTE shall provide MEBTEL unbundled loops where Currently Available. Where GTE utilizes pair gain technology to provision facilities, including Integrated Digital Loop Carrier (IDLC)/1/ or analog carrier, GTE may not be able to provision an unbundled loop, in which event an unbundled loop would not be Currently Available. Where GTE can provision an unbundled loop using pair gain technology, the capabilities of such unbundled loop may be limited to what GTE provisions. If an ordered unbundled loop using pair gain technology does not meet MEBTEL's requirements, GTE will, where Currently Available, use alternate facilities to provision the unbundled loop. If alternate facilities are not Currently Available or do not meet MEBTEL requirements, GTE will advise MEBTEL that facilities are not available to provision the requested unbundled loop. GTE will not be required to construct additional facilities at GTE's expense to provide the unbundled loop for MEBTEL. Where Tel USA can provision an unbundled loop using pair gain technology, the capabilities of such unbundled loop may be limited to what Tel USA provisions. If an ordered unbundled loop using pair gain technology does not meet Lakeland’s requirements, Tel USA will, where Currently Available, use alternate facilities to provision the unbundled loop. If alternate facilities are not Currently Available or do not meet Lakeland requirements, Tel USA will advise Lakeland that facilities are not available to provision the requested unbundled loop. Tel USA will not be required to construct additional facilities at Tel USA's expense to provide the unbundled loop for Lakeland. Lakeland may use the Bona Fide Request (BFR) process specified in Article VII of this Agreement to request Tel USA to construct additional facilities at Lakeland expense.

If an ordered unbundled Loop using Pair Gain technology does not meet DSL requirements, GTE will, where currently available, use alternate facilities to provision the unbundled Loop. If alternate facilities are not currently available or do not meet DSL requirements, GTE will advise DSL that facilities are not available to provision the requested unbundled Loop. GTE will not be required to construct addition facilities at GTE’s expense to provide the unbundled Loop for DSL. DSL may use the Bona Fide Request (BFR) process specified in Article VIII of this Agreement to request GTE to construct additional facilities at DSL’s expense.
Pair Gain Technologies. GTE cannot provide an unbundled loop that ---------------------- currently is being provisioned using integrated digital loop carrier ("IDLC") technology or analog carrier technology. Where GTE utilizes other types of pair gain technology to provision the loop element, GTE may be able to provide an unbundled loop, depending on the technology involved, but the capabilities of the loop may be limited. If XXX orders an unbundled loop to a location that is normally served by pair gain technology and GTE cannot meet the requirements of the ordered loop using the pair gain technology, GTE will use alternate facilities, if available, to provision the loop. If alternate facilities are not available, GTE will advise XXX that facilities are not available to provision the loop. GTE will not construct additional facilities at GTE's expense to provide the loop for XXX, but XXX may use the bona fide request process in Article VIII of this Agreement to request that GTE construct additional facilities at ELI's expense.

  • Technology Discoveries, innovations, Know-How and inventions, whether patentable or not, including computer software, recognized under U.S. law as intellectual creations to which rights of ownership accrue, including, but not limited to, patents, trade secrets, maskworks and copyrights developed under this Agreement.

  • Computer Systems (a) Servicer to operate systems The Servicer shall operate and maintain systems capable of providing data processing, management information and other related information technology requirements to enable it to carry out the Services.

  • EMERGING TECHNOLOGIES The State reserves the right to modify the terms of this Contract or any future Periodic Recruitments, to allow for emerging technologies. OGS reserves the right to include such technology(ies) hereunder or to issue a formal modification or amendment to this Contract.

  • Information Technology The following applies to all contracts for information technology commodities and contractual services. “Information technology” is defined in section 287.012(15), F.S., to have the same meaning as provided in section 282.0041, F.S.

  • WSIB & LTD An Employee who is receiving benefits under the Workplace Safety and Insurance Act, or under a LTD plan, is not entitled to benefits under a school board’s sick leave and short term disability plan for the same condition unless the employee is on a graduated return to work program then WSIB/LTD remains the first payor. For clarity, where an employee is receiving partial benefits under WSIB/LTD, they may be entitled to receive benefits under the sick leave plan, subject to the circumstances of the specific situation. During the interim period from the date of the injury/incident or illness to the date of the approval by the WSIB/LTD of the claim, the employee may access sick leave and short term leave and disability coverage. A reconciliation of sick leave deductions made and payments provided, will be undertaken by the school board once the WSIB/LTD has adjudicated and approved the claim. In the event that the WSIB/LTD does not approve the claim, the school board shall deal with the absence consistent with the terms of the sick leave and short term leave and disability plans.

  • How Much May I Contribute to a Xxxxxxxxx Education Savings Account? The maximum contribution that can be made to all Xxxxxxxxx Education Savings Account that cover a particular beneficiary may not exceed $2,000. It is the joint responsibility of the contributor and the beneficiary to verify that excess contributions are not made on behalf of a particular beneficiary. Qualifying rollover contributions and transfers are not subject to these limitations. Note that special rules apply to contributions to Xxxxxxxxx Education Savings Accounts for purposes of gift and estate taxes. In addition, if your adjusted gross income (or combined income if you file a joint tax return) as modified below exceeds certain limits, you are not eligible to make a contribution to a Xxxxxxxxx Education Savings Account. For this purpose your adjusted gross income is increased by amounts excluded under Section 911 (certain exclusions applicable to U.S. citizens or residents living abroad), Section 931 (certain exclusions applicable to U.S. citizens or residents living in Guam, American Samoa, or the Northern Mariana Islands), and Section 933 (certain exclusions applicable to U.S. citizens and residents living in Puerto Rico) of the Code. The amount you may contribute to a Xxxxxxxxx Education Savings Account for a particular beneficiary is reduced proportionately for adjusted gross income (as modified above) within the applicable dollar range. The applicable dollar range is $95,000 to $110,000 for an individual, a married individual filing a separate tax return or a head of household and for a married individual filing a joint tax return this range is increased to $190,000 to $220,000. To determine the amount you may contribute to a Xxxxxxxxx Education Savings Account, you can refer to IRS Publication 970: MAGI for a Xxxxxxxxx ESA and Xxxxxxxxx ESA Contribution Limit.

  • Computer Software The Grantee certifies that it has appropriate systems and controls in place to ensure that state funds will not be used in the performance of this Grant Agreement for the acquisition, operation, or maintenance of computer software in violation of copyright laws.

  • Multi-Year Planning The CAPS will be in a form acceptable to the LHIN and may be required to incorporate (1) prudent multi-year financial forecasts; (2) plans for the achievement of performance targets; and (3) realistic risk management strategies. It will be aligned with the LHIN’s then current Integrated Health Service Plan and will reflect local LHIN priorities and initiatives. If the LHIN has provided multi-year planning targets for the HSP, the CAPS will reflect the planning targets.

  • MERCURY ADDED CONSUMER PRODUCTS Contractor agrees that it will not sell or distribute fever thermometers containing mercury or any products containing elemental mercury for any purpose under this Contract.

  • Computer Access Where possible, providing no additional costs are incurred by the Employer, one (1) authorized representative of each Union shall be entitled to submit for posting on the Employer's electronic communication system one electronic Union notice per month for members of the bargaining unit. The Employer shall determine the method of distribution. The Employer shall review all proposed notices and retain a discretion not to post any notice that it deems unlawful or contrary to the Employer’s interests, which discretion shall not be unreasonably exercised. The Union agrees to indemnify the Employer for any liability arising out of offensive or otherwise unlawful notices posted by the Union. Nothing in this Article requires a change to distribution practices that existed prior to April 1, 2015.
