NOTICE OF POSITION DISCONTINUANCE. Clause 20.2.1;
NOTICE OF POSITION DISCONTINUANCE. Regular/Seasonal full-time Employees and regular/seasonal part-time employees shall be given a minimum of fifteen (15) working dayswritten notice of Position Discontinuance by the Employer. If the Employer fails to give the required notice of layoff, the employee shall be paid in lieu of notice an amount equivalent to the amount of notice that is lacking. Vacation time is not to be used by the Employer as part or all of notice of layoff. A copy of the Notice of Position Discontinuance shall be sent to Human Resources, which in turn will notify the Union of the Position Discontinuance.

  • Termination Notice for Force Majeure Event If a Force Majeure Event subsists for a period of 180 (one hundred and eighty) days or more within a continuous period of 365 (three hundred and sixty five) days, either Party may in its discretion terminate this Agreement by issuing a Termination Notice to the other Party without being liable in any manner whatsoever, save as provided in this Article 34, and upon issue of such Termination Notice, this Agreement shall, notwithstanding anything to the contrary contained herein, stand terminated forthwith; provided that before issuing such Termination Notice, the Party intending to issue the Termination Notice shall inform the other Party of such intention and grant 15 (fifteen) days time to make a representation, and may after the expiry of such 15 (fifteen) days period, whether or not it is in receipt of such representation, in its sole discretion issue the Termination Notice.

  • Abandonment of Position An employee who fails to report for duty for three (3) consecutive working days without informing the Employer of the reason for her absence will be presumed to have abandoned her position. An employee shall be afforded the opportunity within ten (10) working days to rebut such presumption and demonstrate that there were reasonable grounds for not informing the Employer.

  • Notice of Force Majeure Event 14.2.1. As soon as practicable and in any case within 3 days of the date of occurrence of a Force Majeure Event or the date of knowledge thereof, the Party which is rendered wholly or partially unable to perform any of its obligations under this Agreement because of a Force Majeure Event (the “Affected Party”) shall notify the other party of the same, setting out, inter alia, the following in reasonable detail:

  • Notice of Material Breach and Intent to Exclude The parties agree that a material breach of this IA by Xxxxx constitutes an independent basis for Xxxxx’x exclusion from participation in the Federal health care programs. The length of the exclusion shall be in the OIG’s discretion, but not more than three years per material breach.
