Notice of Commercial Operation. Seller shall notify PGE not less than five (5) Business Days in advance of the anticipated date of Commercial Operation and shall confirm to PGE in writing when Commercial Operation has been achieved.
Notice of Commercial Operation. Subject to the provisions of this Agreement, Installer shall notify and represent to Homeowner and Compact when the PV System has achieved commercial operation (“Notice of Commercial Operation”), and shall in such notice certify the Commercial Operation Date. Buyer shall, within five (5) Business Days, in writing either accept or reject this notice in its reasonable discretion, and if Buyer rejects the notice, Buyer shall specifically identify any defects or deficiencies, Seller shall either promptly correct any defects or deficiencies identified by Xxxxx and resubmit the notice, or initiate dispute resolution in accordance with Section 15.4 in response to Buyer’s rejection. Subject to the remaining provisions of this PPA, Owner shall notify Host Customer in writing when the SEF has achieved Commercial Operation (each, a “Notice of Commercial Operation”), and shall in such notice state the Commercial Operation Date. Unless waived by Host Customer, Owner shall cause such Commercial Operation Date to occur no later than ten (10) months following completion of Utility’s supplemental review or the signing of this PPA, whichever comes later.

The parties anticipate that the COD will occur on or about October 1, 2013, but WMRE shall not be in default pursuant to this Agreement and shall have no liability to City Light if the COD is delayed beyond such anticipated date. As requested by City Light, WMRE will provide updated estimates of the COD.
