No Unauthorized Warranties. MSP shall make no representations or warranties with respect to the Commercial Software beyond those contained herein. MSP shall be solely responsible for, and Elastic shall have no legal obligation to honor, any warranties that MSP provides to MSP Clients to the extent that such warranties are broader or greater in scope than those made by Elastic to MSP hereunder. MSP shall defend, indemnify and hold Elastic and its affiliated companies harmless from any and all costs, losses, damages, liabilities and expenses (including reasonable attorney’s fees and costs of litigation) resulting from MSP’s failure to comply with this Section 6.1.
No Unauthorized Warranties. OEM shall make no representations or warranties with respect to the Commercial Software or the Support Services beyond those contained herein. OEM shall be solely responsible for, and Elastic shall have no legal obligation to honor, any warranties that OEM or any OEM distributor or reseller provides to End Users to the extent that such warranties are broader or greater in scope than those made by Elastic to OEM hereunder. OEM shall defend, indemnify and hold Elastic and its affiliated companies harmless from any and all costs, losses, damages, liabilities and expenses (including reasonable attorney’s fees and costs of litigation) resulting from OEM’s failure to comply with this Section 5.2.
No Unauthorized Warranties. Company shall accurately describe Xxxxxxxxx.Xxx, its Companys, and the Xxxxxxxxx.Xxx Services to each Merchant. Without limiting the generality of the foregoing, Company will make no representation, warranty or description regarding the performance, functional characteristics or other aspects of any Xxxxxxxxx.Xxx Service that is beyond those stated in Xxxxxxxxx.Xxx’s then-current and officially approved marketing and promotional materials for the applicable Xxxxxxxxx.Xxx Service. Company is not authorized to, and will not, make any representation or warranty on behalf of Xxxxxxxxx.Xxx except as Xxxxxxxxx.Xxx may expressly consent to in writing.

Distributor will not make or extend on behalf of HealtheTech any written or oral warranty in repeat of any of the Products except as may be contained in sales literature or brochures that are published or approved in writing by HealtheTech. Distributor will not advise, perform or demonstrate any use or application of any Product that is not specifically approved in writing by HealtheTech. Distributor will not impair the sterility or integrity of the Products while they are in Distributor's custody.
No Unauthorized Warranties. Any representation, warranty or condition -------------------------- with respect to the TVS Software or Technical Support as set forth in the NTI XXXX shall run from NTI to the End-User. OEM shall not make or offer any representation or warranty to any End-User, potential End-User or Other Vendor with respect to the TVS Software and Technical Support other than those representations and warranties made by NTI in the NTI XXXX, and OEM hereby agrees to indemnify and hold harmless NTI from and against any expense (including reasonable attorneys' fees), cost, damage or liability resulting from any representation or warranty made or offered by OEM in violation of this Section 4.3.
No Unauthorized Warranties. Imatron will not make or extend on behalf of TeraRecon any written or oral warranty with respect to any RTR-2000 TeraRecon System without the express prior written consent of TeraRecon. Imatron will not advise, perform or demonstrate any use or application of any XXX-0000 XxxxXxxxx System that is not specifically approved in writing by TeraRecon. Imatron will not impair the integrity of the XXX-0000 XxxxXxxxx System while it is in Imatron's custody.

MJC will not make or extend on behalf of HET any written or oral warranty in respect of any of the Products except as may be contained in sales literature or brochures that are published or approved in writing by HET. MJC will not advise, perform or demonstrate any use or application of any Product that is not specifically approved in writing by HET. MJC will not impair the sterility or integrity of the Products while they are in MJC's custody.
No Unauthorized Warranties. ADP is not authorized to and -------------------------- will not make any representation or warranty on behalf of Concur (including, without limitation, regarding the performance, functional characteristics or other aspects of any of the Concur Products), except as Concur may expressly consent to in writing. If Concur objects to the manner or means in which ADP advertises, markets or otherwise offers any Concur Products, to the extent that the foregoing includesany unauthorized representations or warranties on behalf of Concur in violation of the terms of this Section 11.3, Concur may notify ADP of the nature and scope of such objection and ADP will promptly take such action as may be reasonably required to address and remedy such objection(s) and to bring ADP into compliance with the terms of this Section.
