NO PYRAMIDING OF OVERTIME OR PREMIUM PAY Clause Examples

The "No Pyramiding of Overtime or Premium Pay" clause prevents employees from receiving multiple forms of extra pay for the same hours worked. In practice, if an employee qualifies for both overtime and another type of premium pay (such as holiday or weekend pay) during the same period, they will only receive the higher of the two rates, not both added together. This clause ensures that compensation for extra work is fair and avoids double-counting, thereby controlling labor costs and preventing disputes over pay calculations.
NO PYRAMIDING OF OVERTIME OR PREMIUM PAY. For each hour or part thereof for which an employee is entitled to compensation pursuant to a provision of this Agreement, the employee shall be paid in accordance with the pay formula set forth in this Agreement that would entitle the employee to the greatest amount of monetary compensation, but the employee shall not be entitled to any additional compensation pursuant to any other formula set forth in this Agreement. Premium pay paid to an employee pursuant to the preceding sentence shall not be included in the employee’s regular rate of pay. Any hours for which an overtime or other premium payment has been paid shall be excluded from consideration in determining whether any premium payment shall be made for any other hour or part thereof.
NO PYRAMIDING OF OVERTIME OR PREMIUM PAY. There shall be no pyramiding or duplication of overtime or premium pay. When an employee is eligible for one (1) or more forms of overtime or premium pay, the employee shall receive the higher of the two (2) rates.

  • - Overtime Premium and No Pyramiding Subject to any superior conditions, the overtime rate shall be time and one-half (1-1/2) the employee's straight-time hourly rate. Where an employee is required to work additional overtime contiguous to an overtime shift within a twenty-four (24) hour period, the employee will be compensated at the rate of double time his or her straight time hourly rate for all additional contiguous overtime hours worked.
