Common use of Night Duty Clause in Contracts

Night Duty. 137. Employees shall be paid a premium of 10% of the straight time hourly base rate of pay for each hour regularly assigned between 5:00 P.M. and 7:00 A.M., if the employee works at least one (1) hour of his/her regularly scheduled shift between 5:00 P.M. and 7:00 A.M., excepting those employees participating in an authorized flex-time program and who voluntarily work between the hours of 5:00 P.M. and 7:00 A.M. Shift pay of 10% shall be paid for the entire shift, provided at least five (5) hours of the employee's shift falls between 5:00 P.M. and 7:00 A.M.

Employees shall be paid a premium of 10% of eight (8%) percent more than the straight time hourly base rate of pay for each hour regularly assigned hours worked between 5:00 P.M. and 7:00 A.M., if for the employee works at least one (1) hour of his/her regularly scheduled shift hours actually worked between 5:00 P.M. and 7:00 A.M., excepting those employees participating in an authorized flex-time flex -time program and who voluntarily work between the hours of 5:00 P.M. and 7:00 A.M. Shift pay The above night shift compensation shall only apply when employees are required, as part of 10% shall be paid for the entire their regularly scheduled work shift, provided to work at least five one (51) hour of their shift between the hours of the employee's shift falls between 5:00 P.M. and 7:00 A.M.
