Name of Trust. It is understood that the name "Calamos", and any logo associated with that name, is the valuable property of Calamos Asset Management, Inc., and that the Trust has the right to include "Calamos" as a part of its name or the name of any Fund only so long as this Agreement shall continue. Upon termination of this Agreement the Trust shall forthwith cease to use the "Calamos" name and logo and shall take such action as is necessary to change the name of any Fund and to amend its Declaration of Trust to change the Trust's name.
Name of Trust. The name of the Trust formed under the Original Trust Agreement and the Certificate of Trust is “HomeBanc Mortgage Trust 2006-1,” in which name the Trustee may conduct the business and affairs of the Trust, make and execute contracts and agreements on behalf of the Trust and xxx and be sued.
Name of Trust. The name of the Trust formed hereby shall be "Xxxxxxxxx Mortgage Securities Trust 2003-2," in which name the Trustee may conduct the business and affairs of the Trust, make and execute contracts and agreements on behalf of the Trust and xxx and be sued.
Name of Trust. The Trust agrees and acknowledges that the Adviser is the owner of the name and xxxx “Xxx Xxx” and that all use of any designation comprised in whole or part of Xxx Xxx (a “Van Xxx Xxxx”) under this Agreement shall inure to the benefit of the Adviser. Upon termination of this Agreement for any reason, the Trust shall cease all use of any Van Xxx Xxxx(s) as soon as reasonably practicable.
Name of Trust. It is understood that the phrase "State Street Research" and any logos associated with that name are the valuable property of State Street Research & Management Company, the Manager, and that the Trust has the right to include such phrase as a part of its name and the name of the Funds only so long as this Agreement shall continue. Upon termination of this Agreement the Trust shall forthwith cease to use such phrase and logos.
Name of Trust. Each Trust or any Series may use the name “First Investors” only for so long as this Agreement or any extension, renewal or amendment hereof remains in effect, including any similar agreement with any organization which shall have succeeded to the business of the Manager. At such time as such an agreement shall no longer be in effect, each Trust and each Series will (to the extent that it lawfully can) cease to use any name derived from First Investors Management Company Inc. or any successor organization.
Name of Trust. The Trust may use any name including or derived from ------------- the name "Xxxxxxx Xxxxx" in connection with the Fund only for so long as this Agreement or any extension, renewal or amendment hereof remains in effect, including any similar agreement with any organization which shall have succeeded to your business as investment adviser or administrator. Upon the termination of this Agreement, the Trust (to the extent that it lawfully can) will cause the Fund to cease to use such a name or any other name indicating that it is advised by or otherwise connected with you or any organization which shall have so succeeded to your business.
Name of Trust. The Trust may use any name derived from the name "Xxxxxxx, Xxxxxxx & Xxxxx", if the Trust elects to do so, only for so long as this Agreement, any other investment management agreement between you and the Trust or any extension, renewal or amendment hereof or thereof remains in effect, including any similar agreement with any organization which shall have succeeded to your business as investment manager. At such time as such an agreement shall no longer be in effect, the Trust shall (to the extent the Trust has the legal power to cause it to be done) cease to use such a name or any other name indicating that it is managed by or otherwise connected with you or any organization which shall have so succeeded to your business.
Name of Trust. The Trust or any Series may use the name “Eagle” only for so long as this Agreement or any extension, renewal or amendment hereof remains in effect, including any similar agreement with any organization which shall have succeeded to the business of the Adviser. At such time as such an agreement shall no longer be in effect, the Trust and each Series will (to the extent that it lawfully can) cease to use any name derived from Eagle Fund Distributors, Inc., Eagle Asset Management, Inc. or any successor organization.
Name of Trust. The Contributions received by the Trust from the Company, the investments and reinvestments thereof and any income, earnings and appreciation thereon shall constitute the “Pacific Gas and Electric Company Customer Credit Trust”.
