Legal Authority for Data Sharing. 4. State and federal data practices laws govern the data that will be shared pursuant to this Agreement, including but not limited to the Family Education Rights and Privacy Act (FERPA), 20 X.X.X 0000x, and implementing regulations at 34 C.F.R. Part 99; and the Minnesota Government Data Practices Act (MGDPA), Minnesota Statutes, Chapter 13.

Legal Authority for Data Sharing. 3. OHE is authorized under the Family Education Rights and Privacy Act (FERPA), its Student Aid Internet Gateway (SAIG) Agreement with the U.S. Department of Education and Minn. Stat. § 13.32, subd. 3(e), to disclose otherwise private educational data regarding individual students to another entity in certain circumstances. OHE is a state educational authority as described in 34 C.F.R. § 99.31(a)(3). In accordance with 34 C.F.R. § 99.31(a)(6), FERPA permits state educational authorities to disclose educational records and personally identifiable information (PII) without prior student or parental consent to an authorized representative of the SEA, as defined by 34 C.F.R. § 99.3, for the purposes of auditing or evaluating Federally-supported education programs, or in connection with the enforcement of Federal legal requirements which relate to such programs: Provided, that except when collection of personally identifiable information is specifically authorized by Federal Law, any data collected by such officials shall be protected in a manner which will not permit the personal identification of students and their parents by other than those officials, and such personally identifiable data shall be destroyed when no longer needed for such audit, evaluation, or enforcement of Federal Legal requirements. Any such redisclosure must comply with the requirements of 34 C.F.R. § 99.35(a) and (b); this agreement and its provisions satisfy those requirements. Finally, this agreement complies with Minn. Stat. § 13.32, subd. 3(e), of the Minnesota Government Data Practices Act (MGDPA), which permits disclosure of private student data pursuant to FERPA.
Legal Authority for Data Sharing. The following statutes and regulations provide authority for sharing these data: RCW 39.34, Interlocal Cooperation Act; RCW 42.48, Release of Records for Research, RCW 43.216, Department of Children, Youth, and Families; RCW 26.44.031(6), Records-Maintenance and Disclosure; 42 USC § 5106A(b)(2)(B)(viii)(VI), Child Abuse Prevention and Treatment Act; 45 CFR 205.50(a)(1)(i), Safeguarding Information for the Financial Assistance Programs.

MDE is authorized under FERPA and Minnesota Statutes, Section 13.32, subd. 3(e) to redisclose otherwise private educational data regarding individual students to another entity in certain circumstances. MDE is a state educational authority (SEA) as described in 34 C.F.R. § 99.31(a)(3). In accordance with 34 C.F.R. § 99.35, FERPA permits state educational authorities to redisclose data received from local educational authorities without prior parent consent to an authorized representative of the SEA, as defined by 34 C.F.R. § 99.3. Any such redisclosure must comply with the requirements of 34 C.F.R. § 99.35(a) and (b); this Agreement and its provisions satisfy those requirements. Finally, this Agreement complies with Minn. Stat. § 13.32, subd. 3(e), of the Minnesota Government Data Practices Act, which permits disclosure of private student data pursuant to FERPA.

  • LEGAL AUTHORITY The Contractor warrants and assures H-GAC that it possesses adequate legal authority to enter into this Agreement. The Contractor's governing body, where applicable, has authorized the signatory official(s) to enter into this Agreement and bind the Contractor to the terms of this Agreement and any subsequent amendments hereto.

  • Regulatory Matters The parties will negotiate in good faith to resolve regulatory criticisms or concerns expressed by the Office of the Comptroller of the Currency or other U.S. federal or state banking Regulators that can reasonably be addressed through a modification of the Agreement or adoption of mutually agreeable policies or procedures to prevent or resolve a Material Default described by clause (iii) of such definition, subject to applicable legal requirements including restrictions on disclosing confidential supervisory information.

  • Legal and Regulatory Actions Contractor represents and warrants that it is not aware of and has received no notice of any court or governmental agency proceeding, investigation, or other action pending or threatened against Contractor or any of the individuals or entities included in numbered paragraph 1 of these Contract Affirmations within the five (5) calendar years immediately preceding execution of this Contract or the submission of any related Solicitation Response that would or could impair Contractor’s performance under this Contract, relate to the contracted or similar goods or services, or otherwise be relevant to System Agency’s consideration of entering into this Contract. If Contractor is unable to make the preceding representation and warranty, then Contractor instead represents and warrants that it has provided to System Agency a complete, detailed disclosure of any such court or governmental agency proceeding, investigation, or other action that would or could impair Contractor’s performance under this Contract, relate to the contracted or similar goods or services, or otherwise be relevant to System Agency’s consideration of entering into this Contract. In addition, Contractor acknowledges this is a continuing disclosure requirement. Contractor represents and warrants that Contractor shall notify System Agency in writing within five (5) business days of any changes to the representations or warranties in this clause and understands that failure to so timely update System Agency shall constitute breach of contract and may result in immediate contract termination.
