Incapacity of Participant. In the event that a Participant or other person to whom benefits are being paid, is or becomes unable to care for his own affairs because of illness, accident, or incapacity, either mental or physical, any benefit payments due such incapacitated person may, unless claim shall be made therefor by a duly appointed guardian or other legal representative, be paid to the spouse or other person having the care and custody of such incapacitated person as the Directors shall determine in their sole discretion. Any benefit payments so made shall discharge the obligation of the Directors, the Trustee, and the Fund to the extent thereof.

Incapacity of Participant. If any Participant entitled to receive benefits hereunder shall be physically or mentally incapable of receiving or acknowledging receipt thereof, but no legal representatives have been appointed for him, the Administrator may cause any benefit otherwise payable to him to be made to one or more persons as chosen by the Administrator, and any payment so made shall be a complete discharge of all liability under the plan in respect to such payment.

  • Pregnancy Disability Leave (PDL) - An employee is eligible for continuation of MPS in accordance with applicable law.

  • Normal Retirement Unless Separation from Service or a Change in Control occurs before Normal Retirement Age, when the Executive attains Normal Retirement Age the Bank shall pay to the Executive the benefit described in this section 2.1 instead of any other benefit under this Agreement. If the Executive’s Separation from Service thereafter is a Termination with Cause or if this Agreement terminates under Article 5, no further benefits shall be paid.
