INCAPACITATED PERSONS. A contract entered into where one of the parties is incapable of giving consent to a contract is voidable (Art. 1390). If both parties are incapable of giving consent, the contract is unenforceable unless they are ratified (Art. 1403, 3).

INCAPACITATED PERSONS. In case any payment becomes payable to --------------------------------- a person under legal disability, or to a person not adjudicated incompetent but who by reason of illness or mental or physical disability is, in the opinion of the Committee, unable properly to administer such amounts, the payment may be made by the Trustee for the benefit of such person in such of the following ways as the Committee shall direct in writing: (a) to such person; (b) to the legal representative of such person; (c) to such person's spouse; or (d) to some relative of such person by blood or marriage.
INCAPACITATED PERSONS. The Trustees may by resolution direct payment of any benefits under the Plan payable to any incapacitated person to the legal guardian or committee of any such person, whose receipt will be a sufficient discharge to the Trustees. The Trustees are not bound to see to the application of any benefits so paid. The Trustees will establish a policy for the payment of benefits to minors or incapacitated persons and must specifically ensure that a trustee be appointed to receive the interest of any minor intended to receive any benefit under the Plan.
