Hammond Site. In the course of xxx xxx xiligence, Seller, by and through its consultant, Heritage Environmental Services LLC ("Heritage"), discovered contamination related to the presence of free product, lead, semi-volatile organic compounds ("SVOCs") and the presence of an underground storage tank ("UST"), among other issues. Groundwater monitoring, due to the presence of historical free product, is required to be conducted at the Hammond Site for one additional quarter. Seller agreed in the May 4, 2004 Letter of Intent, by and between the Parties, to fund an escrow account with up to one hundred thousand dollars ($100,000.00)(less amounts spent by Seller after May 4, 2004 and prior to Closing in connection with said remediation at the Hammond Site which amounts shall be subject to Buyer's review and approval of detailed invoices from Seller's environmental consultant) to fund Buyer's remediation of the Hammond Site and Buyer's reasonable costs and expenses associated with obtaining a Certificate of Completion issued by IDEM and Covenant Not to Sue issued by the Goverxxx of Indiana for the Hammond Site.

  • Premises Parking and Common Areas 2.1 Letting Lessor hereby leases to Lessee, and Lessee hereby leases from Lessor, the Premises, for the term, at the rental, and upon all of the terms covenants and conditions set forth in this Lease. Unless otherwise provided herein, any statement of square footage set forth in this Lease, or that may have been used in calculating rental and/or Common Area Operating Expenses, is an approximation which Lessor and Lessee agree is reasonable and the rental and Lessee's Share (as defined in Paragraph 1.6(b)) based thereon is not subject to revision whether or not the actual square footage is more or less.

  • Site Plan The Landlord covenants that the Center is or shall be developed in accordance with the Site Plan and that it shall be used as a retail shopping center throughout the term of this Lease. The Landlord may not modify or replace the Site Plan without the prior written consent of the Tenant, which consent shall not be unreasonably withheld or delayed. No such modification or replacement shall (i) reduce the ratio of parking spaces to gross leasable area of buildings in the Center shown on the Site Plan, (ii) reduce or rearrange the parking spaces cross-hatched on the Site Plan, (ii) interfere with truck access to the loading doors of the Premises, (iv) interfere with customer access to the Premises or the parking areas closest to the Premises, (v) interfere with the visibility of the Premises from the roads providing direct access to the Center or (vi) result in the construction of any buildings in the area designated "No Build Area" on the Site Plan.

  • Land The real property described in Exhibit A attached hereto and made a part hereof (the “Land”);

  • No Light, Air or View Easement Any diminution or shutting off of light, air or view by any structure which may be erected on lands adjacent to or in the vicinity of the Building shall in no way affect this Lease or impose any liability on Landlord.

  • Project or Building Name and Signage Landlord shall have the right at any time to change the name of the Project or Building and to install, affix and maintain any and all signs on the exterior and on the interior of the Project or Building as Landlord may, in Landlord’s sole discretion, desire. Tenant shall not use the name of the Project or Building or use pictures or illustrations of the Project or Building in advertising or other publicity or for any purpose other than as the address of the business to be conducted by Tenant in the Premises, without the prior written consent of Landlord.

  • Environmental Site Assessments Upon request by Landlord during the Term of this Lease, prior to the exercise of any renewal Term and/or prior to vacating the Premises, Tenant will obtain and submit to Landlord an environmental site assessment from an environmental consulting company reasonably acceptable to Landlord.
