The Redeveloper agrees to amend the Conceptual Master Site Plan to reflect such change in accordance with the provisions of Section 3.1 hereof; provided, however, that in the event the proposed change in use is to either residential or commercial use, then such change shall not be deemed a “substantial change” for purposes of ARTICLE III hereof and shall only require the written consent of the Agency, which consent shall not be unreasonably withheld, delayed or conditioned.
The Developer agrees that the completed project will be constructed in conformance with the Development Site Plan, Construction Plans and other permits or regulatory authorizations granted by the City during the development process.
