Foreign Exchange Report. 於各項帳戶、交易或服務,涉及須向中央銀行申報結購、結售外匯者,客戶須依規定,據實申報並填寫「外匯收支或交易申報書」或由本行在相關法令許可之範內,代客戶為各項相關申報手續(就本行代為申報者,客戶應悉數承認)。於申報結購、結售外匯時,倘因法令規定之限制或因客戶已用滿相關之外匯結匯額度致不能結匯時,應由客戶自行♛責。倘由本行代為申報者,本行對客戶之結匯額度,無主動查詢義務,但倘本行獲知客戶已超出當時結匯額度,本行即有權不予執行該相關交易,若已兌換,則本行得就客戶結匯金額逾限額部份,依本行認為適當之方式逕行沖回。 If the Client is required to report to the Central Bank of China (the“CBC”) for inward/outward remittance of foreign exchange for the purpose of the Accounts, Transactions or Services, the Bank is hereby authorized to fill out the relevant application for inward/outward foreign exchange remittances and report the same to the CBC on behalf of the Client in accordance with the relevant rules and regulations. The Client shall ratify the contents of such applications within the scope of the authorization granted hereunder and shall raise no objection thereto. In the event the Client is restricted from making such conversions due to legal or regulatory restrictions or due to the Client having exhausted the Client’s annual conversion allowance, the Client shall be fully responsible therefor. The Bank has no obligation to verify the balance of the Client’s annual conversion allowance then available; provided, that should the Bank become aware of any non-availability of such allowance, the Bank shall be entitled to refuse to execute relevant Transactions. If any foreign exchange exceeding the annual conversion allowance has been already executed, the Bank may cancel such foreign exchange by any means as the Bank deems appropriate.
