Equal Benefits; Compliance with SMC Ch. 20.45: The City acknowledges that as a public entity, the Agency is exempt from the requirements of SMC Ch. 20.45 and has the right to develop and implement its own program regarding equal benefits for Agency employees with domestic partners. The City recognizes that the Agency has its own program and accepts the Agency’s existing program. At the City’s request, the Agency shall provide complete information and verification of the Agency’s equal benefits program. Failure to cooperate with such a request shall constitute a material breach of this Contract. Equal Benefits; Compliance with SMC Ch. 20.45: The Contractor shall comply with the requirements of SMC Ch. 20.45 and Equal Benefits Program Rules implementing such requirements, under which the Contractor is obligated to provide the same or equivalent benefits (“equal benefits”) to its employees with domestic partners as the Contractor provides to its employees with spouses. At Seattle’s request, the Contractor shall provide complete information and verification of the Contractor’s compliance with SMC Ch. 20.45. Failure to cooperate with such a request shall constitute a material breach of this Contract. Remedies for Violations of SMC Ch. 20.45: Any violation of this Section shall be a material breach of Contract for which the City may: Require Contractor to pay actual damages for each day that the Contractor is in violation of SMC Ch. 20.45 during the term of the Contract; or Terminate the Contract; or Disqualify Contractor from bidding on or being awarded a City contract for a period of up to five (5) years; or Impose such other remedies as specifically provided for in SMC Ch. 20.45 and the Equal Benefits Program Rules promulgated thereunder.

  • Compliance with Equal Benefits Ordinance With respect to the provision of employee benefits, Contractor shall comply with the County Ordinance which prohibits contractors from discriminating in the provision of employee benefits between an employee with a domestic partner and an employee with a spouse.
