Common use of Duties of the Superintendent Clause in Contracts

Duties of the Superintendent. The parties agree that the duties of the position of Superintendent to be performed pursuant to this Contract are set forth in the Franklin Township School Board Policy Handbook, as amended. The parties agree that the description of the duties as Superintendent as stated in the Board Policy Handbook, as amended, represent a reasonable division of responsibilities between the policy making responsibility of the Board, and the implementation and management responsibilities of the Superintendent. The Superintendent agrees that the Superintendent’s duties pursuant to this Contract represent full employment and the Superintendent will not accept outside employment, perform work as an independent contractor, or engage in any other business pursuit involving the Superintendent’s personal services, if any of these activities interfere with the Superintendent’s performance of the Superintendent’s duties as Superintendent, except only as provided in Section 2 above. The parties of this Contract further agree that the duties performed by this Superintendent pursuant to this Contract are unique to this position in the School Corporation, and the Superintendent will therefore not be transferred or reassigned by the Board to another position without the Superintendent’s written consent unless the Superintendent is on leave, incapacitated or otherwise unable to fulfil the duties of Superintendent as determined by the Board. The Superintendent agrees that at all times while the Superintendent is employed pursuant to this Contract the Superintendent will fully meet the minimum qualifications for the position of Superintendent which include maintaining a license from the State of Indiana required for the position of Superintendent.

Duties of the Superintendent. The Superintendent and the Board agree that policymaking is the responsibility of the Board and that the operations and management of the School Corporation are the responsibilities of the Superintendent. The parties further agree that this division of responsibilities is consistent with and shall continue to be implemented consistent with the Indiana School Board Association Code of Ethics for School Board Members, which is incorporated into this Contract as a material term. The parties agree that the duties of the position of Superintendent to be performed pursuant to this Contract are set forth in a job description for the Franklin Township School position, which is defined by Board Policy Handbook, as amendedpolicy and incorporated into this Contract by reference. The parties agree that the description review of the Superintendent’s job performance provided for in paragraph 3 of this Contract shall be based upon the duties as Superintendent as stated in the job description, which job description may be amended from time to time by the Board. The Superintendent shall be responsible to, and shall be subject to, the direct supervision and evaluation of the Board Policy Handbook, as amended, represent a reasonable division of responsibilities between School Trustees of the policy making responsibility Corporation. The Superintendent is also responsible for complying with all directives of the Board, and which are authorized by official Board action. Unless otherwise approved by the implementation and management responsibilities of Board, the Superintendent. The Superintendent agrees that the Superintendent’s his duties pursuant to this Contract represent full time employment and the Superintendent he will not accept outside employment, perform work as an independent contractor, or engage in any other business pursuit involving the Superintendent’s his personal services, services if any of these activities interfere with the Superintendent’s performance of the Superintendent’s his duties as Superintendent, except only as provided in Section 2 above. The parties of this Contract further agree that the duties performed by this Superintendent pursuant to this Contract are unique to this position in the School Corporation, and the Superintendent will therefore not be transferred or reassigned by the Board to another position without the Superintendent’s written consent unless the Superintendent is on leave, incapacitated or otherwise unable to fulfil the duties of Superintendent as determined by the Board. The board will evaluate in writing at least one time annually the performance of the Superintendent. Such evaluation will be conducted in accordance with Indiana law. If the Superintendent is evaluated as either highly effective or effective, then the Board may (but is not required to) in its sole discretion grant to the Superintendent a compensation increase.
