Disability of Consultant. For purposes of this Agreement, the term “disability” (or any similar term) shall mean any bodily injury, disease, illness, or emotional or nervous disorder that prevents the Consultant from performing any or all Consulting Services for a period of at least thirty (30) consecutive days;

Disability of Consultant. For purposes of this Agreement, Consultant shall be deemed to be under a “Disability” if Consultant shall be unable, by virtue of illness, physical or mental incapacity, or disability (from any cause or causes whatsoever), to perform Consultant’s essential job functions hereunder, whether with or without reasonable accommodation, in substantially the manner and to the extent required hereunder prior to the commencement of such disability, for a period exceeding thirty (30) consecutive calendar days. In the event Consultant shall remain under a Disability for a period exceeding thirty (30) days (whether business or non-business days and whether consecutive or non-consecutive), the Company shall have the right to terminate Consultant’s engagement hereunder at the end of any calendar month.
Disability of Consultant. If the employment of the Consultant shall terminate on account of his having become "disabled", as such term is defined in Section 7(c) of the Employment Agreement, then (a) the Option may be exercised (to the extent as of the date of the termination of Consultant's employment by reason of having becoming disabled) by the Consultant or the Consultant's personal representative, as the case may be, at any time within one (1) year after the date on which the Consultant's employment terminated by reason of his disability in accordance with the terms of the Employment Agreement, but not beyond the original term of the Option, and (b) the portion of the Option that has not vested as of the date of the termination of the Consultant's employment by reason of his having become disabled shall automatically terminate.
