COST OF RESTORATION PLAN. The City and the Contractor shall agree (pursuant to Article 16 of this Contract) upon the costs to be incurred and paid by the City under any Restoration Plan or Alternate Restoration Plan which may be agreed to or directed by the City and which is implemented by the Contractor, or in the absence of such agreement, shall be based upon the actual and reasonable costs. In the event a dispute arises with respect to such costs the City agrees to pay all amounts not in dispute to the Contractor. The disputed amounts shall be subject to dispute resolution pursuant to Article 16 of this Contract. The Contractor shall submit monthly invoices to the City for such costs.
