Compliance with Laws and Zoning and Other Requirements; Encroachments. Borrower is in compliance with the requirements of all applicable Laws. To the best of Borrower’s knowledge, the use of the Property complies with applicable zoning ordinances, regulations and restrictive covenants affecting the Land. All use and other requirements of any Governmental Authority having jurisdiction over the Property have been satisfied. No violation of any Law exists with respect to the Property. The Improvements are constructed entirely on the Land and do not encroach upon any easement or right-of-way, or upon the land of others. The Improvements comply with all applicable building restriction lines and set-backs, however established, and are in strict compliance with all applicable use or other restrictions and the provisions of all applicable agreements, declarations and covenants and all applicable zoning and subdivision ordinances and regulations.

To the extent required by applicable Law, Borrower and Guarantor have filed all necessary tax returns and reports and have paid all taxes and governmental charges thereby shown to be due or otherwise owing with respect to Borrower and/or the Property. Borrower has not entered into any PACE Financing and has no knowledge of any pending assessments or adjustments in connection therewith. (c) None of the Property is part of a larger tract of land owned by Borrower or any of its Affiliates, is not otherwise included under any unity of title or similar covenant with other real property not encumbered by a Security Instrument, and each Property constitutes a separate tax lot or lots with a separate tax assessment or assessments, independent of those for any other lands or improvements.
