THE SURVEYS. Promptly after the Opening of Escrow, Buyer shall cause one or more surveyors licensed in the State(s) in which the applicable Properties are located to complete and deliver to Escrow Agent and Buyer a current, certified ALTA survey of the Real Property, Building and Improvements comprising each Property (each, a “Survey” and, collectively, the “Surveys”), whereupon the legal descriptions in the Surveys shall control over the descriptions in Exhibit A-1 attached hereto to the extent they may be inconsistent. Each Survey shall set forth the legal description and boundaries of the applicable parcel of Real Property and all easements, encroachments and improvements thereon.

THE SURVEYS. Seller shall, at its expense, deliver to Buyer a current ALTA “as built” survey for each Property prepared by a national surveyor selected by Seller. If any such survey discloses any encroachments or other adverse matters which are unacceptable to Buyer in its sole discretion, Buyer shall be entitled to terminate this Agreement by delivering written notice thereof to Seller prior to the expiration of the Study Period, whereupon this Agreement shall terminate as provided in Paragraph 7 hereof. In the event Buyer shall not terminate this Agreement as a result of the inspections and investigations to be performed by Buyer pursuant to Paragraph 7 hereof, then and in such event Buyer shall be deemed to have agreed to accept title to and acquire the Property from Seller subject to any matters disclosed by or which would be disclosed by any such survey of the Property obtained by Seller.

THE SURVEYS. Within five (5) business days after receipt of the Substantial Completion Notice for any Property, Buyer, at Buyer’s sole cost and expense, shall order and, thereafter, cause one or more surveyors licensed in the State(s) in which the applicable Property is located to complete and deliver to Escrow Agent, Seller and Buyer a current, certified ALTA survey of the Real Property, Building and Improvements comprising such Property (each, a “Survey” and, collectively, the “Surveys”), whereupon the legal descriptions in the Surveys shall control over the descriptions in Exhibit A-1 attached hereto to the extent they may be inconsistent. Such Survey shall set forth the legal description and boundaries of the applicable parcel of Real Property and all easements, encroachments and improvements thereon. Buyer’s failure to timely deliver the Survey to Seller shall not be a breach or default by Buyer under this Agreement.
THE SURVEYS. Within five (5) days after the Opening of Escrow, Buyer shall order, and within thirty (30) days after the Opening of Escrow Buyer shall cause, one or more surveyors licensed in the State(s) in which the applicable Properties are located to complete and deliver to Escrow Agent and to Buyer, a current, certified ALTA survey of the Real Property, Building and Improvements comprising each Property (each, a “Survey” and, collectively, the Master Purchase Agreement and Escrow Instructions Walgreens — Multi-Site “Surveys”), whereupon the legal descriptions in the Surveys shall control over the descriptions in Exhibit A-1 attached hereto to the extent they may be inconsistent. Each Survey shall set forth the legal description and boundaries of the applicable parcel of Real Property and all easements, encroachments and improvements thereon.

If the legal description as reflected on a Survey differs materially from that set forth in Exhibit A, at Buyer’s request, Seller shall also execute and deliver a quitclaim, non-warranty deed for the applicable Real Property using the legal description as reflected on the Survey.

Each Survey shall set forth the legal description and boundaries of the applicable parcel of Real Property and all easements, encroachments and improvements thereon.
THE SURVEYS. Buyer, at Buyer’s cost, shall, within twenty (20) business days of Opening of Escrow, cause a surveyor licensed in the State in which the applicable Property is located to complete and deliver to Escrow Agent and Buyer a current, certified ALTA survey of the Parcel, Building and Improvements comprising each of the Properties (each, a “Survey” and, collectively, the “Surveys”), whereupon the legal descriptions in the Surveys shall control over the descriptions in Exhibit A-1 attached hereto to the extent they may be inconsistent. At Seller’s election, however, Seller may deliver quitclaim deeds to Buyer including the Properties using the legal description obtained from the Surveys, and the Deeds shall in such event include legal descriptions used on Seller’s title insurance policies. Each Survey shall set forth the legal description and boundaries of the applicable Parcel and all easements, encroachments and improvements thereon.

Each Survey shall set forth the legal description and boundaries of the applicable parcel of Real Property and all easements, encroachments and improvements thereon.
