Clean Up Premium Clause Samples
Clean Up Premium. For performing duties outside of the scope of those normally associated with a trade, the Laboratory will pay a 10% premium for employees, who are “HAZ-WOP- PER” trained, for all hours worked (minimum of 4 hours) in the performance of environmental clean-up duties when such clean-up work requires Haz-Wopper trained personnel wearing “level C” or greater personal, protec- tive equipment. For purposes of clarification only, the following are examples of the types of work for which the 10% premium would not be applicable because they are not indicative of environmental clean-up duties. This list is illustrative and is not meant to be all- inclusive:
a) Spray painting with epoxy paints
b) Boiler water washing
c) Pesticide/insecticide application
d) Duct cleaning/painting e) Scarifying concrete with surface contamination

If during the first six months of the agreement, there are a significant number of disputes over what types of work are “environmental clean up duties,” the 10% premium will be paid only for activi- ties requiring “level B” or greater personal, protective gear. If the parties cannot agree as to whether or not a “significant number” of disputes occurred, this could be submitted to Federal Mediation for a binding decision.
