Character and Competence of Personnel. The Contractor and SFD shall ensure that their respective personnel conduct themselves in a professional and courteous manner. The Contractor’s personnel shall be competent and holders of appropriate permits or certificates in their respective trades or professions. The City may demand the removal of any employee or subcontractor of Contractor, subject to appropriate investigation and determination, for misconduct or incompetent or negligent performance. Such persons shall not be allowed to perform services under this contract without the written consent of the City.

All persons employed by ETMC EMS in the performance of work under this Contract shall be competent and holders of appropriate permits in their respective trades or professions. The Coalition may demand the removal of any person employed by ETMC EMS who engages in chronic misconduct or is chronically incompetent or negligent in the due and proper performance of his duties, and such person shall not be reassigned by ETMC EMS for provision of services under this Contract without the written consent of the Coalition, provided, however, that the Coalition shall not be arbitrary or capricious in exercising its rights under this provision, and shall be required to document in writing the specific reasons for exercising rights relative to any given employee, and shall also give that employee an opportunity to defend himself in the presence of ETMC EMS's chief executive officer and Medical Director and the Coalition prior to removal.

The use of abusive, indecent, offensive, coarse, or insulting language, or any form of harassment is prohibited and shall not be tolerated. The Contractor’s employees, agents, and subcontractors shall be competent and hold appropriate licenses and endorsements. The City may require the removal of any employee or subcontractor of Contractor, subject to appropriate investigation and determination, for misconduct or incompetent or negligent performance. Such persons shall not be allowed to perform services under this Contract without the written consent of the City.
