Appeal Process for Suspension Without Pay. After receipt of the notice of intent to 17 suspend without pay, the employee will have the opportunity to request a hearing before the 18 Superintendent/Designee within seven (7) days of the receipt of the notice of intent to suspend 19 without pay. The receipt of any notice or request shall be deemed completed when delivered in 20 person to the employee to whom it is directed, or when it is deposited in the United States certified 21 mail, postage prepaid and addressed to the last address the employee has given the Human 22 Resources office. The decision of the Superintendent/Designee will be rendered within ten (10) 23 days of his/her hearing with the employee. If the Superintendent/Designee determines that the 24 suspension should be imposed, the employee will be notified of the dates that the suspension will 25 be in force. The discipline notice shall be delivered to CSEA within twenty-four (24) hours after 26 service on the employee. The employee may request a hearing before the Board within seven (7) 1 days of the receipt of the Superintendent's/Designee's decision. The Board will conduct a hearing 2 on the case and render its decision within fifteen (15) days of the hearing. The decision of the 3 Board will be final and binding.

  • Suspension Without Pay If Employee is suspended and/or temporarily prohibited from participating in the conduct of the Employer's affairs by a notice served under Section 8(e)(3) or (g)(1) of the Federal Deposit Insurance Act, the Employer's obligations under this Agreement will be suspended as of the date of service thereof, unless stayed by appropriate proceedings. If the charges in such notice are dismissed, the Employer may in its discretion:

  • Other Leave Without Pay At its discretion, the Employer may grant leave without pay for purposes other than those specified in this Agreement, including enrolment in the Canadian Armed Forces and election to a full-time municipal office.

  • Authorized Leave Without Pay A. Agency/Departmental Leave‌ A regular, limited-term or probationary employee may request an agency/departmental leave without pay for a period of time not to exceed fifteen (15) calendar days. The granting of such Leave shall be at the discretion of the agency/department, except in cases where Official Leave has been authorized pursuant to B.4., B.5. and Sections 10, 11.A. and 14, below. The agency/department head may require that all accumulated compensatory leave time be used prior to granting of agency/departmental leave. The use of earned vacation or annual leave prior to the obtaining of agency/departmental leave shall be at the option of the employee.

  • Effect of Leave Without Pay No benefits or time credit such as sick leave or vacation shall be earned during the period when an employee is absent on leave without pay.

  • Complete Work without Extra Cost Except to the extent otherwise specifically stated in this contract, the Contractor shall obtain and provide, without additional cost to the City, all labor, materials, equipment, transportation, facilities, services, permits, and licenses necessary to perform the Work.

  • TERMINATION, SUSPENSION OR ABANDONMENT 9.1 This Agreement may be terminated by either party upon not less than seven (7) calendar days' prior written notice should the other party fail substantially to perform in accordance with the terms of this Agreement through no fault of the party initiating the termination.
